Posta sues landlord as GPO branch plunged into darkness

The Postal Corporation of Kenya (PSK) has sued the TelePosta Pension Scheme after it allegedly disconnected electricity supply to the premises at Teleposta Towers.

PSK claims that the registered trustees of the TelPosta Pension Scheme embarked on frustrating it after it notified the scheme of its intention not to renew the lease agreement that expires this December.

Posta claims that the move to disconnect electricity supply on August 26 prevented it from discharging its statutory duty of proving postal services and has in turn affected hundreds of clients.

“A mandatory injunction directing the defendant to restore the plaintiff’s electricity connection within the demised premises basement premises (postal boxes) on Teleposta Towers … in the same state as it was prior to the illegal invasion, trespass and interference with the demised premise,” read one of the order sought by PSK.

PSK says it signed a six-year lease agreement with the scheme commencing January 2013, and ending on December 31, 2018.

The terms of the agreement was that if any of the party wants to terminate the lease, it should inform the other in writing six months to the expiry of the contract.

PSK argues that the scheme is asking for payment of rents, which it says it that it does not owe, having fully paid outstanding bills.

Posta further argues that the disconnection poses a serious security threat to valuables especially customer parcels that are handled within the premises.

On its website, it lists Teleposta Towers - popularly known as GPO - that also houses a Huduma Centre as its main asset.
