Court denies Gakuo, three others bail

Former Nairobi Town Clerk John Gakuo and three others jailed over a cemetery scam will remain in custody after a judge denied them bail, saying they had failed to provide sufficient reasons.

Mr Gakuo, former PS Sammy Kirui, former legal secretary at City Hall Mary Ngethe and Alexander Musee sought to be freed on bail pending the hearing of their appeal.

High Court judge John Onyiego said the issues of age and their medical status raised by Mr Gakuo were not enough to have them released on bail. Justice Onyiego said Mr Gakuo can still get medical services in prison. Through lawyers Asa Nyakundi, Wilfred Nderitu and Osoro Mogikoyo, the four said they have an arguable appeal, with a likelihood of success.

The four former civil servants are serving three years in jail over the irregular purchase of cemetery land for Nairobi. They argued that they would have suffered long in custody, in case their appeal succeeds.
