Unreadable documents in the Sh122million corruption case against the Lugari Member of Parliament Ayub Savula, his two wives Melody Gatwiri and Hellen Jepkorir rocked the trial on Monday.
The accused complained that 45, 000 copies of photocopied witness statements were not legible.
This prompted Chief Magistrate Francis Andayi to direct the Director of Public Prosecutions (DPP) to make available another set of the 1,500 copies of witness statements and exhibits to the defence to copy.
A total of 45,000 copies of the witness statements need to be handed over to the accused to prepare their defences.
Defence lawyers Karathe Wandugi , Cohen Amanya and over 20 other lawyers stated that the State should be compelled to supply the witness statements that are readable.
“It is a constitutional right for all the accused persons to be supplied with statements to prepare their defences,” Mr Wandugi stated.
