Auditor-General Edward Ouko wants legal action taken against troubled Nakumatt Supermarkets to end its blockade of construction of a 39-storey building owned by the National Social Security Fund (NSSF).

A protracted court dispute between the retail chain and the NSSF has delayed construction of what is billed to be Nairobi’s tallest building on completion.

The supermarket chain moved to court three years ago seeking to block the building of additional floors above its Nakumatt Lifestyle branch on grounds that the construction was disrupting its business.

It blocked NSSF contractors from reinforcing columns inside the branch for other floors to be added to the building.

“In view of the foregoing, NSSF should take legal action against the tenant to secure completion of the building to safeguard members’ contribution,” said Mr Ouko in NSSF’s latest audit report.

Construction stalled at the 15th floor and the contractor has so far been paid Sh1.9 billion for a project that was to run between June 2013 and July 2016.
