Judge Onesmus Makau on Wednesday issued the orders after it emerged that it was the government printers that had delayed in publishing a gazette notice with Central Organisation of Trade Unions' boss Francis Atwoli as a member of the Board of trustees of NSSF.
The Employment and Labour Relations Court has granted orders stopping the National Social Security Fund (NSSF) board from holding further meetings until a dispute over its composition is resolved.
Judge Onesmus Makau on Wednesday issued the orders after it emerged that it was the government printers that had delayed in publishing a gazette notice with Central Organisation of Trade Unions' boss Francis Atwoli as a member of the Board of trustees of NSSF.
State counsel Stella Mbilo said the Labour Cabinet Secretary had forwarded Mr Atwoli’s name to the Attorney General’s office and that the AG had also forwarded the name to the Government Printers, but there was a delay in printing, causing an impasse.
“I find that the Labour CS and the AG have not justified the delay in effecting the gazettement of Mr Atwoli’s appointment to NSSF Board. In order to speed up the process of the two complying with the NSSF Act, it is only justifiable that the continued meetings of the NSSF Board be put on hold pending determination of this case,” Justice Makau said.
The judge, however, said that the orders will automatically be lifted should the gazettement be effected before the matter is resolved by court.
